BirthdayBeep Terms of Service

1. Agreement to these terms
By creating an account, signing in, or using BirthdayBeep, you agree to these Terms of Service. If you do not agree, do not use the service.
2. The service
BirthdayBeep helps you store birthday information and receive reminder messages by SMS or through supported connected services. Reminders are provided for convenience and are not guaranteed to arrive at a particular time or without interruption.
3. Accounts and eligibility
You must be at least 18 years old, or the age of majority where you live, to create an account or subscribe. You are responsible for providing accurate information, maintaining control of your phone number and verification codes, and for activity under your account.
4. SMS consent
By providing your mobile number you consent to receive recurring automated transactional texts from BirthdayBeep: verification codes, birthday reminders, optional day-before alerts and weekly summaries, account and billing notices, and replies to messages you send. Message frequency varies with your settings and number of saved birthdays. Message and data rates may apply. Reply STOP to cancel at any time; reply START to resume; reply HELP for help, or reach us through our Contact us form. Carriers are not liable for delayed or undelivered messages. Consent is not a condition of purchase. We never send marketing texts and never share your mobile number or SMS consent with third parties for marketing.
5. Your content and privacy
You retain ownership of the names, dates, notes, and other information you provide. You give BirthdayBeep permission to process that information only as needed to operate, secure, and improve the service. Do not add information you do not have the right to use.
6. Acceptable use
Do not use BirthdayBeep to break the law, harass others, send unwanted messages, interfere with the service, gain unauthorized access, introduce malicious code, scrape the service, or reverse engineer it except where applicable law permits.
7. Subscription and automatic renewal
BirthdayBeep costs $12 per year (plus applicable taxes), charged when you subscribe. Your subscription renews automatically each year at the then-current price and your payment method will be charged until you cancel. Cancel anytime online in Settings → Manage subscription (secure Stripe portal); cancellation takes effect at the end of the current paid year and you keep access until then. Except where required by law, payments are non-refundable.
8. Third-party services
BirthdayBeep may rely on third parties for messaging, hosting, payments, and connected services such as Slack and connected AI apps such as Claude or ChatGPT. Their services and terms may also apply. We are not responsible for third-party outages or changes.
9. Availability and changes
We may update, suspend, or discontinue features and may change these terms. If a change is material, we will provide reasonable notice through the service or another appropriate channel. Continued use after the effective date means you accept the updated terms.
10. Suspension and termination
You may stop using BirthdayBeep at any time. We may suspend or terminate access when reasonably necessary to protect users or the service, comply with law, or address a violation of these terms.
11. Disclaimers and liability
The service is provided “as is” and “as available” to the extent permitted by law. We disclaim implied warranties where legally allowed. To the fullest extent permitted by law, BirthdayBeep will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability will not exceed the greater of the amounts you paid in the 12 months before the claim or US $50.
12. General terms
These terms are governed by the laws of the State of California, excluding conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Marin County, California, except that either party may bring an individual claim in small-claims court. Nothing here limits rights you have under the consumer-protection laws of your place of residence. If part of these terms is unenforceable, the remaining terms stay in effect. These terms are the entire agreement regarding the service unless additional terms are presented for a specific feature. If the English and Spanish versions conflict, the English version controls.
